Frequently Asked Questions on Public Country-by-Country Reporting (pCbCR)

Opti.Tax Cloud pCbCR is the perfect tool for making income tax information available to the general public securely and in full. We have compiled answers to the questions we have received from interested professionals.

pCbCR is the European Union’s Public Country-by-Country Reporting scheme. Certain large, cross-border companies are required to make a report containing income tax information publicly available.

The standard CbCR is prepared for tax authorities and is, in principle, confidential. The pCbCR is published publicly, follows its own data and country logic, and uses a machine-readable EU format.

In principle, this applies to certain EU parent companies, independent EU companies, and EU subsidiaries or branches of non-EU groups, provided that the turnover and structural requirements are met.

The EU regulation is generally based on a turnover of more than EUR 750 million in two consecutive financial years. Whether a company is specifically affected also depends on its group structure and how the regulation is implemented at national level.

This requirement generally applies to the first financial year beginning on or after 22 June 2024. The report must be published no later than twelve months after the relevant balance sheet date.

These include, amongst other things, operations, staff numbers, revenue, profit before tax, income tax recognised and paid, and retained earnings. The consolidated group and reporting parameters are also specified.

Each EU Member State is, in principle, shown separately. Certain non-cooperative tax jurisdictions are also shown individually; other third countries may, in principle, be aggregated.

The common EU standard provides for a human-readable XHTML document containing embedded, machine-readable Inline XBRL data and an EU taxonomy.

The report must be available in at least one official language of the European Union. Additional national requirements may apply. Opti.Tax Cloud is provided in numerous European languages to facilitate international cooperation.

The report is published via the competent authority or register designated under national law and is, in principle, also made available on the company’s website. National exceptions and procedures must be observed.

Under the EU framework, the report should, in principle, remain publicly available on the website for at least five years.

Yes. Non-EU groups may be subject to the disclosure requirements through medium-sized or large EU subsidiaries or certain EU branches.

Some Member States may permit the temporary omission of specific, particularly harmful information. The conditions, grounds and requirements for subsequent disclosure are strict and vary from country to country.
