The EU General Data Protection Regulation (GDPR) comes into force on 25 May 2018. The GDPR establishes uniform EU-wide rules governing the processing of personal data by organisations and public authorities. One important change introduced by the GDPR is the rights to information and the obligations to provide information.
Adjustments for ERiC
In compliance with this obligation to provide information, the tax administration has drawn up a general information notice on the processing of personal data in tax proceedings („General Information on the Implementation of the Data Protection Requirements of Articles 12 to 14 of the General Data Protection Regulation within the Tax Administration“) and adapted the general data protection notice in the licence agreements for ERiC to comply with the GDPR.
The licence agreements for ERiC have been amended accordingly. These amended licence agreements can be found in the installation details from version 18.1 onwards. By using our software from version 18.1 onwards, the user agrees to the new licence agreements.
From the moment you install version 18.1 – that is, upon accepting the licence agreements – you are contractually obliged, in accordance with Clause 5 of the licence agreements, to take note of both the updated privacy notice and the general information notice. You must also actively confirm that you have taken note of these (by clicking the mouse), and this must be done before any data is transmitted to the tax authorities.
A leaflet on data protection issues
When tax authorities process personal data, this means that they, for example, collect, store, use, transmit, make available for retrieval or delete such data. The tax authorities provide information on this in a leaflet,
■ what personal data is collected and
■ from whom they will collect the data, and
■ what happens to this data.
The information sheet also sets out your rights regarding data protection and explains who you can contact in this regard. The information sheet issued by the tax authorities is attached as an appendix; you can download it for your records. This information will also be available from Opti.Tax Version 18.1.0 is displayed in the relevant sections of the software – including in the Help section, during dispatch, and in the licence terms. You must confirm that you have read the information regarding the GDPR before dispatch.
