What is a digital signature?
In legal terms, a digital signature is what is known as an electronic signature. The provisions that were previously laid down at national level in the German Signature Act are now set out in the eIDAS Regulation on electronic identification and trust services, which applies across the EU. With a digital signature, you can sign a document (e.g. a loan agreement) online without using paper. This speeds up processes and saves costs. The legal framework for this is provided by the EU-wide eIDAS Regulation. It defines the legal effect of electronically signed documents and their evidential value in court. With d.velop sign, you can create simple, advanced and qualified signatures.How does a digital signature work?
You upload your document to the Opti.Tax Cloud, which incorporates d.velop sign technology. When you upload the document and request a digital signature, a hash value is sent to a trust service provider for certification. The provider verifies your identity and then returns the hash value. You can then download your signed document along with the corresponding certificate. By simplifying the signing process in this way, you not only increase your level of digitalisation but also save valuable time and money.Is it permissible to sign contracts digitally?
Legislation can now be enacted using remote signature services. You affix your signature to the document using a signature certificate. This certificate verifies your identity through a third party and is time-stamped. The qualified electronic signature is legally valid in court and is therefore suitable for signing contracts.What types of digital signatures are there?
A simple electronic signature does not provide any added value in terms of security for businesses and is subject to the court’s discretionary assessment of evidence (Section 286 of the German Code of Civil Procedure (ZPO)). The advanced electronic seal signature is also subject to the court’s discretion in assessing evidence (Section 286 of the German Code of Civil Procedure (ZPO)) and ensures the integrity of the document by means of a certificate. Only the qualified electronic personal signature (QeS) replaces the statutory written form (Sections 126 and 126a of the German Civil Code (BGB)) and is therefore equivalent to a handwritten signature.System requirements
